Chouchou Bebe Wentworth Point – Participation & Liability Waiver. Please read carefully — this is a legal agreement governed by the laws of New South Wales (NSW). Completion of this form is mandatory prior to entry.

1. Supervision & Responsibility
I understand that I am responsible for supervising my child(ren) at all times while on the premises.
I confirm my child(ren) is/are physically and medically fit to participate in the activities.
I acknowledge that Chouchou Bebe is a children’s play café, and normal play activities carry inherent risks, such as slips, falls, bumps, or collisions.

2. Assumption of Risk
I acknowledge and accept that activities may include (but are not limited to): use of jungle gyms, trampolines, inflatable jumping castles, slides, climbing structures, ball pits, ride-on toys, and other indoor play equipment.
These activities involve movement, height, and physical interaction, which carry risks such as slips, trips, falls, collisions with equipment or other participants, and other accidental injuries.
I voluntarily assume all risks associated with participation in these activities, except where injury, loss, or damage is caused by the Provider’s negligence.
I understand that participation is voluntary and at my own risk.

3. Release of Liability
In consideration of entry, I release and waive all claims against Chouchou Bebe Wentworth Point (including its owners, officers, employees, and agents) for any injury, loss, or damage, except to the extent such loss or damage is caused by the Provider’s negligence or is otherwise not permitted to be excluded under the Competition and Consumer Act 2010 (Cth) (Australian Consumer Law) or the Civil Liability Act 2002 (NSW).
Nothing in this waiver is intended to exclude, restrict, or modify any rights I have under the Australian Consumer Law or other applicable laws that cannot be excluded or limited by law.

4. Indemnity
I agree to indemnify and hold harmless the Provider from any third-party claims, liability, or costs arising from my child(ren)’s actions while on the premises.

5. Personal Belongings
I acknowledge that the Provider is not responsible for loss, theft, or damage to personal belongings brought onto the premises.

6. Food & Allergies
I understand that if outside food or drink is brought for self-catered events, the Provider is not responsible for any allergic reactions, illness, or injury arising from its preparation, handling, or consumption.

7. Behaviour, Rules of Play & Right to Refuse Entry
I agree to follow all posted venue rules and any safety instructions given by staff.
The Provider reserves the right to refuse entry or request a person to leave if behaviour poses a safety risk, breaches rules, or causes disruption to others.

8. Emergency Medical Consent
I authorise staff to administer first aid and/or arrange emergency medical assistance if required, and accept responsibility for any related costs.

9. Force Majeure
I acknowledge that the Provider is not liable for closures, delays, or cancellations caused by events beyond its reasonable control (e.g., severe weather, power outages, government restrictions).

10. Ongoing Application & Withdrawal
This waiver applies to today and all future visits until I withdraw it in writing via email to [email protected].

11. Governing Law & Severability
This waiver is governed by the laws of New South Wales. Any dispute will be resolved exclusively in the courts of New South Wales.
If any provision of this waiver is found invalid or unenforceable, the remaining provisions will continue in full force and effect.

12. Privacy and Communications
We respect your privacy. The personal details you provide are collected for booking, safety and record keeping purposes in line with privacy laws. We may also contact you by emails with updates, special offers and news about ChouChou Bebe. You can opt out of these emails at any time by clicking "unsubscribe" in the email or contacting us directly at [email protected].

I agree to release Chouchou Bebe Wentworth Point and its affiliates from all claims

I understand that this waiver applies today and to all future visits until I withdraw it in writing via email to [email protected]
